Definitions

• “Company” refers to CampFinder Asia Sdn. Bhd., a company incorporated in Malaysia.
• “Platform” refers to the website https://campfinderasia.com and any related services.
• “User” refers to any person accessing or using the Platform.
• “Provider” refers to any third-party organisation or individual listing camps, programmes, or services on the Platform.
• “Content” refers to listings, text, images, descriptions, logos, and other materials displayed on the Platform.

2. Nature of the Platform

CampFinder Asia operates solely as an online directory and discovery platform.

The Company:

• Does not organise, operate, supervise, or deliver any camps or programmes
• Is not a childcare provider, school, or education operator
• Does not act as an agent, broker, or representative of any Provider
• Does not guarantee availability, quality, safety, legality, or suitability of any listed service

All camps and programmes are independently owned and operated by Providers.

3. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms and Conditions and all applicable Malaysian laws.
If you do not agree, you must not use the Platform.

4. Listings and Accuracy of Information

• Providers are solely responsible for the accuracy, completeness, and legality of their listings.
• While reasonable efforts are made to present information clearly, the Company does not warrant or guarantee that any listing is current, accurate, or error-free.
• The Company reserves the right to edit, suspend, or remove listings at its discretion without notice.

5. User Responsibilities

Users agree to:

• Conduct their own due diligence before engaging any Provider
• Communicate directly with Providers regarding bookings, safety, insurance, policies, and suitability
• Comply with all applicable laws when using the Platform

The Platform must not be used for unlawful, misleading, defamatory, or abusive purposes.

6. Bookings, Payments, and Contracts

• Any booking, payment, or agreement entered into is strictly between the User and the Provider
• The Company is not a party to any contract formed between Users and Providers
• The Company does not process payments, hold funds, or handle refunds unless explicitly stated otherwise

7. Fees and Advertising

• Some Providers may pay fees for enhanced listings, advertising, or promotional placement
• Paid placement does not constitute endorsement or recommendation
• Advertising content remains the responsibility of the Provider

8. Limitation of Liability

To the maximum extent permitted under Malaysian law:

• The Company shall not be liable for any loss, injury, damage, delay, or dispute arising from:
  • Participation in any camp or programme
  • Acts or omissions of Providers
  • Inaccurate or incomplete listing information
  • Website downtime or technical issues

All use of the Platform is at the User’s own risk.

9. Indemnity

Users and Providers agree to indemnify and hold harmless the Company, its directors, officers, and employees from any claims, losses, damages, or expenses arising from:

• Use of the Platform
• Breach of these Terms
• Any dispute between Users and Providers

10. Intellectual Property

• All Platform content (excluding Provider content) is owned by or licensed to the Company
• Providers retain ownership of their own trademarks and content
• No content may be copied, reproduced, or reused without written permission

11. Data Protection and Privacy

Personal data is processed in accordance with:

• Malaysia’s Personal Data Protection Act 2010 (PDPA)

Use of the Platform is also subject to the Company’s Privacy Policy.

12. Third-Party Links

The Platform may contain links to third-party websites.
The Company:

• Has no control over external sites
• Is not responsible for their content, policies, or practices

13. Suspension and Termination

The Company reserves the right to:

• Suspend or terminate access to the Platform
• Remove listings or user access
  Where there is a breach of these Terms or applicable law.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

15. Changes to Terms

The Company may amend these Terms at any time.
Continued use of the Platform constitutes acceptance of the updated Terms.
